Terms of Use & End User License Agreement

These Terms of Use and End User License Agreement, together called the “Terms,” govern your access to and use of SShoty, the screenshot and markup application for Mac. By downloading, installing, opening, accessing, purchasing, or using SShoty, you confirm that you have read, understood, and agreed to these Terms, to the SShoty Privacy Policy, and to the SShoty Acceptable Use Policy. If you do not agree, do not use SShoty.
Acknowledgement. You acknowledge and agree that these Terms are concluded between you and MAHTCA GLOBAL (the “developer”), and not with Apple, and that the developer, not Apple, is solely responsible for SShoty and its content. Apple has no obligation to furnish any maintenance, support, or warranty services in respect of SShoty, and is not responsible for addressing any claims you or any third party may have relating to SShoty or your possession or use of it, except as expressly provided in these Terms or in Apple’s own published terms. Section 32 (Apple Third-Party Beneficiary) describes Apple’s separate and independent right to enforce these Terms against you.
SShoty copies every capture to your clipboard and keeps a history of your recent captures on your Mac, but that history is not a backup: it keeps at most 300 captures and deletes the oldest automatically and permanently, it does not keep the markup you add, and an app crash, a system crash, a power failure, a full disk, or any other interruption can cause a capture or your changes to be lost. The developer does not guarantee that your captures, or the changes you make to them, will be preserved. Copy or save every capture that matters to you and keep regular backups. Before you paste or share a capture, check what it shows: a capture can contain more than you intended, the original, unblurred capture is placed on your clipboard and kept in the history, and blur is not guaranteed to make hidden content unreadable. To the maximum extent permitted by law, the developer is not responsible for any loss of your captures or data, or for any disclosure of what they contain. See Section 2, Section 3, Section 4, Section 5, Section 25, and Section 26.
1. Overview
SShoty is a screenshot application for Mac. It lets you capture your screen — an area, a free-form shape, a circle, an area with rounded corners, a window, the screen under your cursor, or all of your displays stitched into one image — with an optional delay, and it copies every capture to your clipboard automatically. Depending on the features available to you, SShoty also lets you mark up captures with a pen, arrows, lines, shapes, text, a highlighter, numbered steps, and blur; copy the text in part of your screen (Grab Text); freeze the screen, re-capture a pinned region, place a window on a backdrop (Hero Shot), dim everything except a chosen area (Spotlight), capture at a fixed aspect ratio (Fit Ratio), or take a timed series of captures (Burst); combine captures into a collage; capture from the menu bar; and save captures as PNG files. SShoty captures still images only; it does not record video or audio.
SShoty does not require an account. It is designed to run locally on your Mac. Your captures, and the history SShoty keeps of them, are stored on your Mac, or wherever you choose to save them, and remain under your control, subject to your device settings, operating-system behaviour, Apple services, backup settings, iCloud settings, and any third-party apps or services you choose to use.
2. Keep Your Own Copies of Captures
You are solely responsible for keeping copies and backups of your captures. Copy or save every capture that matters to you to a location of your choice, and maintain regular backups — for example, with Time Machine or another backup system of your choice.
SShoty automatically keeps each capture, as a full-resolution PNG image with a smaller thumbnail, in a capture history inside its own private data folder on your Mac. The history holds at most 300 captures. When a new capture takes the history past that limit, SShoty automatically and permanently deletes the oldest captures, whichever version of SShoty you use, without asking you first. In the free version, only your 10 most recent captures are shown; older captures that are still stored are hidden, not deleted, and count towards the 300-capture limit (see Section 15). SShoty does not export the history as a whole; you can open a capture from the history and copy it or, with SShoty Pro, save it.
The markup you add in the editor — pen strokes, arrows, lines, shapes, text, highlights, numbered steps, and blur — is not saved, and collages are not added to the history. The history keeps only the original capture. When you open another capture or take a new one, the markup on the capture you were editing is discarded and cannot be recovered. Copy or save a marked-up image or a collage before you move on.
The history is a convenience. It is not a backup, is not guaranteed to exist or to be complete, and can be lost — for example, if SShoty’s data is deleted, if your Mac fails, or if storage runs out. Never rely on SShoty, its history, your clipboard, or undo as the only copy of a capture.
3. Capturing, Saving, Interruptions, and Data Loss
Capturing, copying, and saving involve writing data to your clipboard and your storage. Although SShoty is designed to handle your captures carefully, the developer does not guarantee that any capture will be taken, copied, added to the history, or saved completely or correctly, that a saved file will open, or that any capture, change, or data will not be lost or damaged.
SShoty writes each full-resolution capture to its history in the background, shortly after the capture is taken, and writes a file only when you choose Save and pick a location in the macOS Save dialog. If you choose to replace an existing file, its previous contents are lost. A capture, a saved file, the history, or your changes may be lost, damaged, corrupted, truncated, partially written, or made unreadable if any interruption or failure occurs, including without limitation: SShoty quitting or crashing unexpectedly; macOS crashing, restarting, or stopping responding; loss of power, a depleted battery, sleep, or a forced shutdown or restart; you or the operating system force-quitting or terminating SShoty, including under low-memory or thermal pressure; a software or system update; your disk or volume becoming full, read-only, disconnected, or damaged; an external, network, or cloud drive — including iCloud Drive and other file providers — disconnecting, syncing, offloading, or modifying a file while it is in use; another app, user, or process opening, locking, moving, or changing a file; file-permission changes; security or antivirus software; file-system errors; or hardware failure.
Captures and markup that you have not copied or saved elsewhere can be lost at any time. You agree to copy or save your work promptly and to keep your own copies and backups as described in Section 2. To the maximum extent permitted by law, the developer accepts no liability for any loss of, damage to, or corruption of any capture, file, change, or data, however caused, including in any of the circumstances described in this Section.
4. Automatic Copying to the Clipboard
SShoty copies every capture to your clipboard automatically, as soon as it is taken, and this cannot be turned off. Grab Text copies the recognized text instead of an image. Each copy replaces whatever was on your clipboard before, and that earlier content is lost unless you have kept it elsewhere. The automatic copy is made before you mark up or blur the capture, so your clipboard holds the original, unedited capture until you copy the edited image or copy something else.
Anything on your clipboard can be read by other apps on your Mac, including clipboard managers, and, if Handoff is turned on, may be made available on your other Apple devices through Universal Clipboard. These are macOS features outside SShoty’s control. You are responsible for checking what is on your clipboard before you paste it, and for replacing or clearing it where it contains sensitive information.
5. Sensitive Content, Blur, and Sharing
A capture records everything visible in the area, window, or screens you choose at the moment it is taken, which can include personal, confidential, or third-party information, such as messages, notifications, names, email addresses, account details, or other windows. Timed captures — including captures with a delay and Burst, which takes a series of captures of the screen under your cursor automatically at the interval you set — record whatever is on screen when they fire, including content that appears after you start them. Every capture is added to the history and copied to your clipboard, as described in Section 2 and Section 4.
SShoty’s blur tool hides the area you mark by pixelating it in the image that you copy or save from the editor. The developer does not guarantee that blur will hide all sensitive content, or that hidden content cannot be read, recovered, or reconstructed — pixelated text, numbers, and faces can sometimes remain legible or be reconstructed, particularly when they are large. Blur does not change the original capture: the unblurred original remains in SShoty’s history and, until it is replaced, on your clipboard, and blur does not reach any copy made before you added it. Spotlight dims the parts of the screen outside the area you choose but does not hide them, and dimmed content remains visible. Pen strokes, shapes, highlights, and other markup are not designed to hide content.
Before you paste, share, publish, or send any capture, check all of it yourself, at full size. Where content must not be disclosed, capture only the area you need rather than relying on blur. Copies of a capture may also exist outside SShoty — for example, on your clipboard, in clipboard managers, on your other devices, in files you saved, in backups, and in any app or service to which you pasted or sent it. SShoty does not control those copies, and you are responsible for identifying and deleting them where necessary.
6. Text Recognition and Capture Limitations
Several of SShoty’s features rely on automated analysis and image processing, and their results can be incomplete or wrong. Without limitation: Grab Text recognizes text on your Mac using Apple’s Vision framework and may miss, misread, reorder, or add characters, words, or lines, or find no text at all; Window and Hero Shot captures may select the wrong window or omit parts of it; All Screens stitches your displays into one image that may not match their physical arrangement exactly; Fit Ratio, Spotlight, Hero Shot, Pin Region, Freeze, Burst, and collages crop, re-frame, dim, re-capture, or combine what you capture; and a capture may differ from what you see on screen — for example, in color, scale, or sharpness, or where macOS or another app prevents certain content from being captured. Circle, free-form, and rounded captures contain transparent areas that some apps may display differently or fill with a background.
No output of SShoty, including recognized text, is legal, financial, medical, or other professional advice, and none of it is verified. You are solely responsible for reviewing every capture and result before you rely on it, paste it, share it, or delete anything.
7. Screen Recording Permission and Screen Access
SShoty needs the macOS Screen Recording permission (called Screen & System Audio Recording in recent versions of macOS) to capture your screen. macOS asks you to grant it the first time you take a capture, and you can change it at any time in System Settings ▸ Privacy & Security. If you deny or remove it, SShoty cannot capture your screen. SShoty does not request access to your microphone, camera, location, contacts, calendars, photos, or accessibility features, and it does not record video or audio.
So that the selection overlay appears without delay, SShoty may take a temporary snapshot of your displays and keep the most recent one in your Mac’s memory while SShoty is running — for example, when SShoty opens and the permission has already been granted, when you point at the shutter or choose a capture mode, and when a capture starts. For Freeze and Grab Text, the area you select is taken from that snapshot. Otherwise, the snapshot is used only to display the selection overlay; it is not added to the history, copied to the clipboard, saved to disk, or sent anywhere. While a capture is in progress, SShoty hides its own windows so that they do not appear in the capture.
8. Acceptance, Withdrawal, and Termination
You must accept these Terms to use SShoty. You accept them by downloading, installing, opening, accessing, purchasing, or using SShoty. SShoty does not ask you to accept these Terms within the app and does not record your acceptance; links to these Terms and to the Privacy Policy are shown on the SShoty Pro purchase screen. Continued use of SShoty means that you continue to agree to these Terms. These Terms remain in force until terminated by you or by the developer.
Termination by you. You may terminate these Terms at any time by ceasing all use of SShoty and deleting it from your devices.
Termination by the developer. Your rights under these Terms terminate automatically, without notice, if you fail to comply with any provision of these Terms or of the Acceptable Use Policy. Upon termination, you must immediately cease all use of SShoty and delete it from your devices. No refund or compensation is owed in connection with any termination, except where required by applicable law.
Survival. Termination does not affect any obligation, right, or remedy that, by its nature, is intended to survive, including Sections 2 to 7, 11, 12, 21 to 32, 34, 35, and 38 to 42.
9. Age Requirement
You must be at least 13 years old to use SShoty, or older where the law of your country requires a higher age for the use of digital services without parental consent. If you are under the age of majority where you live, you may use SShoty only with the consent and involvement of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use of SShoty. If you do not meet these requirements, do not download, install, open, purchase, or use SShoty.
10. License to Use the App
Subject to your compliance with these Terms and with the Usage Rules set forth in the Apple Media Services Terms and Conditions (the “Apple Usage Rules”), the developer grants you a limited, personal, revocable, non-exclusive, non-transferable license to use SShoty on Apple-branded products that you own or control, as permitted by the Apple Usage Rules, including any applicable Family Sharing or volume-purchase rules.
You do not acquire ownership of SShoty, its source code, object code, design, interface, icons, branding, workflows, documentation, or other intellectual property. All rights not expressly granted to you are reserved by the developer and its licensors.
11. Restrictions on the Software
You may not distribute SShoty or any copy, component, modified version, extracted portion, build, package, binary, installer, or derivative of SShoty.
Except where expressly permitted by applicable law, you must not: (a) copy, reproduce, redistribute, sell, rent, lease, lend, sublicense, assign, publish, upload, host, mirror, share, transfer, or make SShoty available to any third party; (b) distribute SShoty outside authorized Apple distribution channels; (c) include SShoty in another software package, bundle, marketplace, repository, device image, managed deployment, or commercial service without the developer’s prior written consent; (d) modify, adapt, translate, reverse engineer, decompile, disassemble, attempt to derive the source code of, or create derivative works from SShoty; (e) bypass, disable, or interfere with any in-app purchase, subscription, entitlement, license, watermark, or security mechanism in SShoty; (f) remove, alter, obscure, or misrepresent any copyright, trademark, ownership, licensing, or attribution notice; or (g) use SShoty to build, train, benchmark, or market a competing product in a way that violates these Terms or applicable law.
These restrictions apply to the maximum extent permitted by law and do not limit rights that cannot legally be restricted.
12. Permitted Use and Your Responsibility
SShoty is intended for lawful, privacy-respecting, good-faith use. You are solely responsible for: (a) the captures, recognized text, collages, and images you capture, copy, mark up, blur, combine, save, share, or delete with SShoty, and for their content; (b) having the rights, permissions, consents, and authority needed to capture and use what appears on your screen, including under copyright, contract, confidentiality, employment, and privacy law; (c) keeping copies and backups of your captures; (d) checking every capture and result before you rely on it, paste it, share it, or submit it; and (e) complying with all applicable laws, regulations, platform rules, professional rules, and obligations owed to others.
You must not use SShoty for covert surveillance or covert capture of another person’s screen or activity, to fabricate, falsify, or misrepresent screenshots, to harass or impersonate anyone, to commit fraud, to destroy or conceal evidence, to infringe anyone’s rights, to violate anyone’s privacy, or for any other unlawful or harmful purpose. Detailed rules are set out in the SShoty Acceptable Use Policy, which forms part of these Terms.
13. No Data Collection by the Developer
SShoty is designed not to collect, transmit, sell, rent, share, analyze, or remotely store your captures, their content, recognized text, usage analytics, identifiers, or telemetry on servers controlled by the developer. SShoty does not operate a user-account system, does not upload your captures, and does not use your captures for advertising, tracking, profiling, analytics, model training, resale, or marketing.
To work, SShoty keeps certain information locally on your Mac: your capture history, described in Section 2; your preferences, such as your capture mode, default delay, capture sound, appearance, text size, and whether the console stays on top; whether you have seen the guided tour; and simple counters, such as how many captures you have taken, used to decide when to invite you to rate SShoty. This information stays on your Mac and is not received, accessed, or held by the developer. Further detail is provided in the Privacy Policy.
14. Local Processing, Storage, and File Access
SShoty’s capture, editing, text-recognition, and collage features are designed to run on your Mac. SShoty runs inside the macOS App Sandbox. It keeps its capture history and preferences in its own data folder on your Mac (Library ▸ Containers ▸ com.mahtca.app.macos.SShoty in your home folder) and writes other files only where you choose in the Save dialog. SShoty does not currently provide a way to delete captures from its history within the app. Captures remain until they are deleted automatically as described in Section 2, or until you quit SShoty and delete its data folder. Deleting the SShoty app does not by itself delete that folder, and copies may remain in your backups, such as Time Machine.
SShoty is not designed to connect to the internet itself, and it does not communicate with any server operated by the developer. Purchases and restores are handled by macOS and the App Store, and links in SShoty — such as the links to these Terms, to the Privacy Policy, and to the App Store page where you can review SShoty — open in your web browser or in the App Store.
Your captures remain subject to your own storage, operating-system behaviour, iCloud settings, backup settings, and the other apps and services you use. The developer does not control iCloud, device backups, file providers, cloud-storage services, external or network drives, the clipboard, clipboard managers, messaging or email apps, or any other system or service outside SShoty.
15. Free and SShoty Pro Features
Some of SShoty’s features are available free of charge, and others require SShoty Pro, which is offered as a yearly subscription and as a one-time purchase. On the effective date of these Terms, the free version lets you capture with SShoty’s seven capture modes, set a delay, copy captures, and view your 10 most recent captures in the history, and SShoty Pro adds, among other things, smart capture (Grab Text, Freeze, Pin Region, Hero Shot, Spotlight, Fit Ratio, and Burst), the markup and blur tools, saving to disk, the collage builder, capture from the menu bar, captures without a watermark, and access to the full capture history. The features included in each tier are described in SShoty and on its App Store page, and may change over time, subject to applicable law.
Watermark. In the free version, SShoty adds a visible “SShoty” watermark to every image capture. The watermark becomes part of the image itself: it is included in the copy placed on your clipboard and in the capture kept in the history, and it cannot be removed afterwards, including if you later obtain SShoty Pro. SShoty adds the watermark only after it has determined that you do not have SShoty Pro; if SShoty does not recognize a valid purchase at the time of a capture, that capture may be watermarked, and the developer is not liable for it.
History. In the free version, only your 10 most recent captures are shown in the history. With SShoty Pro, all stored captures are shown, up to the 300-capture limit described in Section 2. If SShoty Pro ends — for example, because a subscription lapses or a purchase is refunded — SShoty again shows only your 10 most recent captures; older captures are hidden, not deleted, and remain subject to the 300-capture limit. Any description of SShoty Pro as including “unlimited history” means that the free-version display limit does not apply; it does not mean that the history has no limit.
Free features are provided free of charge, as a courtesy, and to the maximum extent permitted by law without any warranty or liability of any kind.
16. Purchases, Payments, and Refunds
In-app purchases as licenses. Each in-app purchase grants you a limited, personal, revocable, non-exclusive, non-transferable license to access the corresponding features for the period and on the terms shown at the time of purchase. You do not acquire ownership of any feature, code, content, or other component of SShoty. In-app purchases are licenses to use, not sales of goods, and remain subject to these Terms, the Apple Usage Rules, and applicable law.
Purchases are processed by Apple through the App Store, and Apple is the merchant of record. The developer does not receive or store your payment details. Apple may process purchase, refund, tax, invoice, subscription, device, account, and transaction information under Apple’s own terms and privacy policies. The developer is not responsible for Apple’s payment processing, refund decisions, billing rules, taxes, exchange rates, chargebacks, subscription management, Family Sharing rules, or App Store availability. If Apple refunds or revokes a purchase, the corresponding SShoty Pro features end.
Refunds and withdrawal. Requests for refunds or cancellations must be made to Apple and are subject to Apple’s policies and applicable law. If you are a consumer in the European Union or the European Economic Area, you may have a statutory right to withdraw from a distance purchase within 14 days. Where you request that the digital content or service be supplied immediately, you acknowledge that, to the extent permitted by Article 16(m) of Directive 2011/83/EU and equivalent national law, you lose your right of withdrawal once supply has begun.
17. Subscriptions and Auto-Renewal
SShoty Pro is offered as a yearly auto-renewing subscription (shown in SShoty as “Yearly”). A subscription grants you a limited, personal, revocable, non-exclusive, non-transferable license to access SShoty Pro features for the duration of an active, paid subscription period. When a subscription lapses, is cancelled, is refunded, is revoked, or otherwise ends, that license ends, and SShoty Pro features return to the locked state until you subscribe again or make the one-time purchase.
The subscription title, length, and price shown in the App Store and in SShoty at the time of purchase are the binding terms of that subscription. Payment is charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically at the then-current price for the same period unless automatic renewal is turned off at least 24 hours before the end of the current period, and your Apple Account is charged for renewal within the 24 hours before the current period ends. You can manage or cancel your subscription at any time in System Settings, under your Apple Account, in Media & Purchases, or in the App Store.
Cancelling stops future renewals; the current paid period remains active until its end date, and no refund is provided for any unused portion except where required by law. If Apple cannot collect payment, Apple may offer a billing grace period during which access continues; if payment is not collected, the subscription lapses. If the price of a subscription increases, Apple notifies you in advance and, where required, asks for your consent. If a free trial or introductory offer is provided, its terms are shown before you subscribe, and any unused portion of a trial is forfeited when you purchase a subscription where applicable.
SShoty checks your purchases on your Mac using records provided by Apple. Until SShoty has confirmed that you have SShoty Pro, SShoty Pro features remain locked, and SShoty does not provide any grace period of its own when a subscription ends or cannot be confirmed. SShoty may be temporarily unable to recognize a valid purchase — for example, if you are signed in to a different Apple Account, or during an outage of Apple’s services — and the developer is not liable for any such temporary unavailability or for its consequences, including a watermark added to a capture under Section 15. You can restore a valid purchase with Restore on the SShoty Pro screen, using the Apple Account used to make it.
18. One-Time (Lifetime) Purchase
SShoty may offer a one-time, non-consumable purchase of SShoty Pro (shown in SShoty as “One Time” and described on the SShoty website as “lifetime”). It grants you a personal, revocable, non-exclusive, non-transferable license — not ownership — to access the SShoty Pro features for as long as the purchase is recognized as valid by Apple’s App Store systems and for the lifetime of the applicable SShoty product, feature set, and platform support. “Lifetime,” “one payment,” “yours forever,” and similar descriptions refer to the lifetime of that license and product; they do not mean the lifetime of the user, the developer, any company, any device, any operating system, the App Store, Apple services, or any third-party service, and they do not transfer any ownership interest in SShoty or any part of it.
The developer will not charge you again for the same SShoty Pro feature set on the same supported platform, provided that: (a) the purchase remains valid and is not refunded, reversed, revoked, charged back, found fraudulent, or otherwise invalidated; (b) SShoty remains available, maintained, operable, and supported on the relevant platform; (c) your device, operating system, Apple Account, and Apple’s services continue to support recognition or restoration of the purchase; and (d) continued access is not prevented by law, regulation, court order, platform rule, security requirement, technical limitation, or circumstances outside the developer’s reasonable control. A one-time purchase covers the SShoty Pro feature set identified at the time of purchase, together with any fixes or improvements the developer chooses to provide, but not separate future applications, products, or services, features released as a distinct paid product or subscription, or features on platforms not included in the original purchase. Where supported by Apple, you may restore a valid purchase using the Apple Account used to make it. The developer does not control Apple’s purchase records, refund decisions, Apple Account status, Family Sharing behaviour, App Store availability, device compatibility, or operating-system support.
19. Apple Terms and Third-Party Services
Your use of SShoty may also be subject to Apple’s App Store terms, the Apple Media Services Terms and Conditions, device and operating-system terms, iCloud terms, and any applicable third-party terms, and you agree to comply with them.
SShoty may use, link to, or interact with services provided by Apple or other third parties, such as the App Store, macOS services including screen capture, the Vision text-recognition framework, the clipboard and Universal Clipboard, the Save dialog, iCloud Drive and other file providers, and websites you open from links (together, “External Services”). External Services are provided by their operators under their own terms and policies. The developer does not control, endorse, or assume responsibility for any External Service, and you use them at your own risk.
Apple is not responsible for SShoty, its content, maintenance, support, claims, warranties, or your use of it, except as Apple may separately provide under its own terms or applicable law.
20. Maintenance and Support
The developer is responsible for maintenance and support of SShoty only as stated in these Terms or as required by applicable law. Apple has no obligation to provide maintenance or support services for SShoty. The developer has no obligation to recover, repair, or restore any capture or data. Ordinary support questions about using SShoty can be sent to sshoty@mahtca.com. 21. Ownership of Your Content
You retain all rights you already have in your captures. SShoty does not claim ownership of any capture, recognized text, collage, or other content you create or process with it. Capturing content with SShoty does not give you any right in that content. You represent that you have the rights, permissions, and lawful authority needed for everything you do with SShoty, including where a capture contains the work, messages, personal data, image, or likeness of another person.
22. Intellectual Property
SShoty, including its software, design, interface, graphics, icons, workflows, branding, names, documentation, and related materials, is owned by the developer or its licensors and is protected by copyright, trademark, trade-secret, and other intellectual-property laws. You may not use the SShoty name, logos, branding, screenshots, interface, or other proprietary materials in a way that suggests endorsement, affiliation, resale, redistribution, or ownership without the developer’s prior written permission.
23. Privacy and Data Roles
The developer does not receive, access, host, or store the captures that you take or handle with SShoty, or any text recognized from them. Because the developer never sees or holds your captures, the developer does not act as a “controller” or “processor” of their content within the meaning of the EU General Data Protection Regulation, the UK GDPR, or equivalent laws. When you use SShoty to capture, copy, mark up, or share content — including messages, faces, names, or other personal data about you or other people that appears on your screen — you determine the purposes and means of that processing on your own device, and you are solely responsible for its lawfulness and for any obligations owed to others.

24. Security
SShoty is designed to operate locally, but no software, device, operating system, or workflow can be guaranteed to be error-free, uninterrupted, secure, or immune from data loss. SShoty does not lock or encrypt its capture history separately from your Mac: anyone who can use your macOS user account can open SShoty and view your recent captures and your clipboard. You are responsible for securing your Mac — including with a strong login password and, where appropriate, FileVault — for keeping macOS up to date, for managing app permissions, for maintaining backups, and for controlling who can access your Mac and the captures SShoty keeps on it.
25. No Warranty
SShoty is provided “as is” and “as available,” with all faults and without warranty of any kind. To the maximum extent permitted by applicable law, the developer and its owners, contributors, licensors, and affiliates disclaim all warranties, representations, and conditions of any kind, whether express, implied, statutory, or otherwise, including the implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, title, accuracy, quiet enjoyment, non-infringement, availability, uninterrupted or error-free operation, capture success, recognition accuracy, redaction completeness, file recovery, and compatibility with any device, operating system, display, app, or service. Without limitation, the developer does not warrant that any capture or change will be taken, copied, preserved, saved, or recoverable; that the history will keep any capture; that saved files will be complete, uncorrupted, or readable by other software; that a capture will contain exactly what you intended and nothing more; that blur or Spotlight will hide sensitive content; or that recognized text will be accurate.
No oral or written information or advice given by the developer or by Apple creates a warranty. Should SShoty or any function prove defective, you assume the entire cost of any servicing, repair, recovery, or correction. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you, and you may have additional rights under the mandatory consumer-protection law of your country of residence. You use SShoty at your own risk.
26. Limitation of Liability
To the maximum extent permitted by applicable law, the developer and its owners, contributors, licensors, and affiliates will not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss or damage of any kind, arising out of or relating to SShoty or these Terms, including damages for: (a) loss of, damage to, or corruption of captures, history, markup, collages, files, clipboard contents, backups, or data, including the automatic deletion of older captures from the history; (b) failed, partial, delayed, or irreversible capturing, copying, saving, recognition, or deletion, including as a result of app crashes, system crashes, power loss, force-quit, termination by the operating system, system updates, full or disconnected storage, or any other interruption; (c) content captured unintentionally, content not hidden by blur, Spotlight, or markup, content exposed through the clipboard, clipboard managers, or Universal Clipboard, or any other disclosure of sensitive information; (d) watermarks added to captures; (e) reliance on recognized text or any other output of SShoty; (f) lost profits, revenue, business, opportunity, goodwill, or reputation, emotional distress, or business interruption; (g) the acts or omissions of Apple, iCloud, operating systems, file providers, third-party apps, or other external systems; or (h) any unlawful, negligent, or unauthorized use of SShoty by you or by any third party.
To the maximum extent permitted by applicable law, the developer’s total aggregate liability for all claims relating to SShoty will not exceed the greater of: (a) the amount you paid for the SShoty Pro purchase or subscription from which the claim arises during the twelve months before the event giving rise to the claim; or (b) EUR 25. For free features, the developer’s liability is excluded to the maximum extent permitted by law. Where liability for loss of data cannot be excluded, it is limited to the typical cost of restoring the data from the backup copies that you should have kept in accordance with Section 2.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for intentional misconduct or gross negligence where the law does not permit its exclusion, under mandatory product-liability law, or under the mandatory rights of consumers — including the rights of consumers in the European Union regarding the conformity of digital content and services under Directive (EU) 2019/770 and its national implementations.
27. Indemnity
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the developer and its owners, contributors, licensors, affiliates, officers, employees, agents, and successors (the “Indemnified Parties”) from and against all claims, demands, investigations, regulatory inquiries, enforcement actions, liabilities, damages, judgments, awards, fines, penalties, losses, costs, and expenses, including reasonable legal fees, expert fees, and reasonable internal investigation costs, whether arising in any jurisdiction in the world, that arise from or relate to: (a) your use or misuse of SShoty; (b) the captures, recognized text, collages, and images you capture, copy, mark up, blur, combine, save, share, or delete with SShoty, and their content; (c) your violation of these Terms or the Acceptable Use Policy; (d) your violation of any law, regulation, court order, contract, or third-party right, including intellectual-property, privacy, data-protection, publicity, and confidentiality rights, and including the EU GDPR, the UK GDPR, the California Consumer Privacy Act and California Privacy Rights Act, the Brazilian LGPD, the Chinese Personal Information Protection Law, the Indian Digital Personal Data Protection Act, the Australian Privacy Principles, and the Canadian PIPEDA; (e) any claim by a person whose screen, messages, personal data, image, likeness, or work appears in a capture you made, kept, shared, or deleted with SShoty; (f) any fabricated, altered, staged, or misleading screenshot, or any capture you represent as genuine, complete, or unaltered; (g) your reliance on any capture or output of SShoty, or your use of SShoty in connection with employment, professional, evidence-preservation, journalistic, or fiduciary obligations owed to any third party; or (h) any chargeback, payment dispute, or fraudulent transaction initiated by you.
The Indemnified Parties may, at their option and at your expense, assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate. You must not settle, compromise, or admit liability in any such matter without the developer’s prior written consent, and you must promptly notify the developer at sshoty@mahtca.com of any actual or threatened claim. Your indemnification obligations apply whether or not the underlying claim is ultimately found to be valid, and survive your deletion of SShoty and any termination of these Terms.
28. Product Claims
You and the developer acknowledge that the developer, not Apple, is responsible for addressing any claims by you or any third party relating to SShoty or your possession and use of it, including: (a) product-liability claims; (b) any claim that SShoty fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer-protection, privacy, or similar legislation. This Section does not make the developer liable for any claim or damage that is excluded or limited elsewhere in these Terms to the maximum extent permitted by applicable law.
29. Intellectual Property Claims
If a third party claims that SShoty or your possession and use of it infringes that party’s intellectual-property rights, the developer, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of that claim, subject to these Terms and applicable law. You must promptly notify the developer of any such claim and must not admit liability or settle it without the developer’s prior written consent.
30. Apple Warranty Acknowledgement
If SShoty fails to conform to any applicable warranty that cannot legally be disclaimed, you may notify Apple, and Apple will refund the purchase price for SShoty, if any, in accordance with Apple’s rules. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to SShoty, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the developer’s responsibility only to the extent required by applicable law and subject to these Terms.
31. Export and Legal Compliance
You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country; (b) you are not listed on any U.S. Government list of prohibited or restricted parties; and (c) your use of SShoty complies with all applicable export-control, sanctions, and trade laws, including those of the European Union and Romania. You may not use, export, re-export, or transfer SShoty except as permitted by applicable law and these Terms.
United States Government end users. SShoty and its documentation are “Commercial Items,” as defined at 48 C.F.R. §2.101, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation,” licensed to United States Government end users only as Commercial Items and with only the rights granted to all other end users under these Terms.
32. Apple Third-Party Beneficiary
Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
33. Availability, Updates, and Feature Changes
The developer may update, modify, suspend, remove, replace, or discontinue SShoty or any feature at any time, subject to applicable law and Apple’s rules. Updates may change how SShoty captures, copies, edits, stores, or displays captures, including the capture history. Some features depend on your Mac’s capabilities, your displays, the version of macOS, the Screen Recording permission, storage, or Apple services. The developer does not guarantee that SShoty or any feature will remain available, compatible, unchanged, or supported. Copy or save the captures that matter to you before installing any update to SShoty or macOS.
34. Events Outside the Developer’s Control
The developer is not liable for any delay, failure, partial performance, data loss, interruption, unavailability, loss of purchase recognition, or other adverse outcome caused in whole or in part by events or conditions outside its reasonable control, including: acts or omissions of Apple, the App Store, or Apple’s in-app purchase services; changes, deprecations, or removals in operating systems, screen-capture or permission systems, services, file formats, or device capabilities; failures of hardware, displays, storage, third-party apps, file providers, cloud services, or networks; malware, cyber attacks, or unauthorized access; natural disasters, epidemics, war, civil unrest, or terrorism; governmental, regulatory, or judicial action; power, utility, or internet failures; and labour disputes. During any such event, the developer may suspend, restrict, or modify any feature without prior notice and without liability, and is under no obligation to provide refunds, credits, or compensation except where required by applicable law.
35. Professional, Regulated, and High-Risk Use
SShoty is a general-purpose consumer application. It is not designed, tested, or certified for use where its failure, an error in a capture, or the loss or disclosure of a capture could lead to death, personal injury, serious environmental or property damage, or significant financial, legal, or regulatory consequences. It is not a records-management, archiving, monitoring, compliance-recording, legal-hold, e-discovery, forensic, or evidence-preservation system, and its captures are not authenticated or tamper-evident and do not prove the date, time, source, completeness, or authenticity of what they show. If you use SShoty in connection with legal, medical, financial, governmental, regulated, or other professional work, you do so at your own risk and remain solely responsible for verifying every capture and for meeting your professional, record-keeping, retention, and confidentiality obligations.
36. Assignment
You may not assign, transfer, delegate, or sublicense your rights or obligations under these Terms without the developer’s prior written consent, except where prohibited by applicable law. The developer may assign or transfer these Terms in connection with a merger, acquisition, restructuring, sale of assets, transfer of the app, change of control, or similar transaction, subject to applicable law.
37. Changes to These Terms
The version of these Terms published at www.sshoty.mahtca.com/terms/ is the authoritative version. SShoty links to that version; any copy of these Terms made available elsewhere is provided for your convenience, and where the two differ, the published version controls. You accept these Terms, as then in force, each time you download, install, open, access, purchase, or use SShoty.
The developer may update these Terms to reflect changes in SShoty, applicable law, Apple’s requirements, or its practices. When it does, the version number and effective date change. Where a change materially affects your rights, the developer will use reasonable efforts to inform you before it takes effect — for example, on the SShoty website or in an update to SShoty. If you do not accept an update, your remedy is to stop using and delete SShoty. These principles apply equally to the Privacy Policy and the Acceptable Use Policy.
38. Governing Law and Jurisdiction
These Terms, and any dispute arising out of or in connection with them or with your use of SShoty, are governed by the laws of Romania, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. The courts of Dolj County, Romania, have non-exclusive jurisdiction over any such dispute.
Nothing in this Section deprives you of the protection of the mandatory consumer-protection rules of the country in which you reside. Consumers in the European Union, the European Economic Area, and the United Kingdom may rely on those rules and may bring proceedings in the courts of their country of residence where those rules allow. Consumers in Romania may also contact the National Authority for Consumer Protection (ANPC, anpc.ro), including about alternative dispute resolution.
39. Severability and No Waiver
If any part of these Terms is found to be invalid, illegal, or unenforceable, that part will be enforced to the maximum extent permitted by law or modified to achieve the closest lawful effect, and the remaining parts will remain in full force and effect. No failure or delay by the developer in exercising any right or remedy operates as a waiver of it.
40. Entire Agreement
These Terms, together with the Privacy Policy and the Acceptable Use Policy, constitute the entire agreement between you and the developer regarding SShoty and supersede any prior or contemporaneous agreements on that subject. Apple’s terms, App Store rules, and applicable third-party terms may also apply separately.
41. Language
These Terms may be translated for convenience. If there is a conflict between a translation and the English version, the English version controls, except where applicable law requires otherwise.
42. Your Acknowledgement
By downloading, installing, opening, purchasing, or using SShoty, you acknowledge that you have read, understood, and agreed to these Terms. In particular, you acknowledge that SShoty cannot guarantee that your captures or the changes you make to them will be preserved; that its history keeps at most 300 captures and deletes the oldest automatically, and does not keep your markup; that crashes, power failures, and other interruptions can cause captures and changes to be lost; that every capture is copied to your clipboard automatically; that blur and Spotlight may not hide content reliably; that in the free version captures carry a permanent watermark; that you will copy or save the captures that matter and keep regular backups; and that you accept these risks. If you do not agree, do not use SShoty.
